Terms & Conditions

1. Our Contract:

1.1 These terms and conditions apply to all goods supplied by Easybrows  (the “Supplier”, or “we”, or “our”) to the customer (“you”, or “your”) and constitute the entire and only agreement between us in relation thereto.

1.2 All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

1.3 We will send you an order acknowledgement (via email) shortly after you place your order, notifying you that we have received your order. This acknowledgement is not notification that we have accepted your order.

1.4 If we accept your order, we will notify you by email when we have dispatched the goods. If we cannot accept your order (for example (but without limitation) because the goods are found to be unavailable) we will notify you by telephone or email.

1.5 In the event that, after we accept your order, we discover that the goods ordered are unavailable or that there was a pricing error on our website in respect of the goods ordered, we reserve the right not to supply the goods ordered and to offer you a refund.

1.6 The contract is subject to your right of cancellation. (see condition 4.1)

1.7 We have the right to terminate the contract if the price of the goods is not received from you in cleared funds

1.8 The Supplier may change these terms of sale without notice to you in relation to future sales.

2. Description and Price of Goods

2.1 The description and price of the goods you order will be as shown on our website at the time you place your order.

2.2 On occasion, the prices payable of goods advertised on our web site may differ from those prices offered at our trade counters, and we are under no obligation to honour any website price if there is such a difference.

2.3 Occasionally an error may occur with our website and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.

3. Payment & Delivery

3.1 Payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order.  Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.

3.2 There will be no delivery until cleared funds are received.

3.3 The goods you order will be delivered to the delivery address you give when you place your order.

3.4 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you of any delay as soon as possible and will give you the option of cancelling your order at this point.

3.5 Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as “UNCHECKED”. Failure to do so may affect any warranty claims that you make thereafter.

4. Returns & Refunds

4.1 If you wish to return an item after the goods have been delivered to you, this must be done within 14 days of our despatch date. Please include your original receipt in the returned parcel and please also state the reason for the return. Please note that the postal costs for returned goods are your responsibility and will be reimbursd by the Supplier only in the case of damaged, faulty or incorrectly supplied goods. We recommend  sending return items by registered post and keep your proof of postage receipt, as we cannot be responsible for goods lost or damamged in transit. The goods must be returned to the address shown on the Contact page of the website. The product you return must be in its original, new and unused condition with all the original packaging. We do not accept any item for refund with any indication that it was used. In such cases the item will be returned to the purchaser.

4.2 If you wish to receive a refund we will credit the original purchaser’s credit card for the sum paid less any taxes, duties and shipping charges.

4.3 Faulty goods should be returned in their original packaging. Any goods found to be faulty will be replaced or refunded.

5. Warranty & Liability

5.1 All of our products are covered by a manufacturers warranty covering both faulty materials and faulty workmanship, it does not cover general wear and tear or damage. This excludes products or parts of products that are consumables or that wear down.

5.2 Most faulty products will need to be examined before we replace. Please note that we cannot be held responsible for lost returns so please ensure you return them via an appropriate courier or insured method as we do not accept any liability until received by us.

5.3 We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.

5.4 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

5.5 Goods are intended for use in Europe and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the European Union. All goods are sold in accordance with the manufacturer’s specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.

5.6 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

5.7 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
